Our rental terms, policies, and conditions for luxury car services
1. Who We Are
DeluxeDrive LDA (trading as "DeluxeDrive", "we", "us" or "our") is a luxury car rental company registered in Portugal with NIF 517580420, registered office at Villa 2, Caixa Postal 378-Z, Areeiro, 8100-225 Loulé, Portugal, and operational base at R. de Santa Catarina 1207, 8135-011 Almancil, Algarve, Portugal.
We are a direct rental company. We own and operate our own fleet of luxury vehicles, and every rental is provided by us — not by third parties. We are not a marketplace, booking platform, or intermediary, and we do not broker rentals on behalf of other operators. When you rent a car through DeluxeDrive, your agreement is directly with DeluxeDrive LDA.
These Terms and Conditions, together with our Privacy Policy and the individual rental agreement you sign for each rental, set out the terms on which we provide our services. We may update these Terms from time to time; the version published on this page at the time your booking is confirmed is the version that applies to it.
2. How Booking Works
There is no online booking or online payment on this website. Every rental begins with a personal conversation, and every booking is confirmed individually. The process is:
- (a) Enquiry — you contact us via WhatsApp (+351 963 584 279), phone, email, or the contact form on this website;
- (b) Consultation — we discuss your dates, vehicle, delivery location, and requirements, and provide a personalised quote. We typically respond within 30 minutes during business hours;
- (c) Confirmation — once you accept the quote, we confirm your booking directly with you in writing, including the price, deposit, mileage allowance, and any delivery details;
- (d) Rental agreement — a written rental agreement is signed at or before delivery of the vehicle, and this agreement governs the rental itself.
Enquiries are free
Sending us an enquiry is free of charge, carries no obligation, and does not require any payment or card details. You are only committed to a rental once a booking has been confirmed and the applicable terms agreed with us.
3. Driver Requirements & Documents
Minimum age
The driver and any additional driver must be at least 18 years of age and hold a valid driving licence issued at least 1 year ago. There is no age-based surcharge.
Documents
At or before delivery, each driver must present:
- (a) A full, valid driving licence (expired or provisional licences are not accepted);
- (b) A valid passport or identity card;
- (c) An International Driving Permit, where required — this may apply to some licences issued outside the EU. If you are unsure whether your licence requires one, contact us at info@deluxedriverentals.pt and we will confirm before your rental.
Additional drivers
Additional drivers are welcome, provided they meet the same requirements and are named in the rental agreement. Only drivers named in the rental agreement may drive the vehicle; use by an unauthorised driver voids insurance coverage.
Fitness to drive
We may decline to release the vehicle if the driver's ability to drive appears impaired for any reason, or if the required documents are not presented.
4. Pricing, VAT & Payment
Pricing
Rental prices are shown on each vehicle's page and confirmed in your personalised quote. Your booking confirmation states the full price for your rental, including any delivery fees, so there are no surprises. Portuguese VAT at 23% applies to rentals.
Payment methods
Payment is made at booking or at delivery, as agreed in your booking confirmation — never through this website. We accept credit cards, bank transfer, cryptocurrency, and cash. An invoice is issued using the billing details you provide.
This website never asks for, processes, or stores card or payment details.
5. Security Deposit
A refundable security deposit applies to each rental. The deposit amount depends on the vehicle and is shown on the vehicle's page and confirmed at booking.
Depending on the payment method agreed for your rental, the deposit is either held as a card pre-authorisation or collected and refunded after return — the method that applies to your rental is agreed at booking and stated in your rental agreement. In both cases the deposit is released or refunded after the vehicle is returned, subject to inspection. If charges apply — for example damage for which the renter is responsible, missing fuel, excess kilometres, or fines — the corresponding amount may be deducted, and we will itemise any deduction for you. If the damage exceeds the deposit, the renter remains responsible for the remainder, as set out in the rental agreement.
If we are unable to secure the deposit before delivery, we may be unable to release the vehicle.
6. Insurance
Every rental is insured. All vehicles carry, at minimum, the third-party liability insurance required by Portuguese law. The exact coverage level for your rental — including any full or comprehensive coverage options, and any applicable excess — is stated in your quote and in the rental agreement you sign. Where the rental agreement provides liability-only coverage, the renter is responsible for damage to the vehicle, with the security deposit applied first, as set out in the rental agreement.
Any optional coverages and exemptions are voided by serious breaches of the rental agreement — including use by drivers not named in the agreement, driving under the influence of alcohol or drugs, unauthorised travel outside Portugal, or use of the vehicle in violation of the law. In such cases the renter is fully liable for any damage, theft, or loss, without prejudice to the mandatory third-party liability insurance.
7. Fuel Policy — Return at Any Fuel Level
Vehicles are delivered to you with fuel. You may return the vehicle at any fuel level — there is no obligation to refuel before returning, and there are no refuelling penalties or service fees. If fuel is missing at return, it is simply charged at cost.
Please use only the correct fuel type for the vehicle. Misfuelling is not covered by insurance, and repair and towing costs arising from use of the wrong fuel are the renter's responsibility.
8. Mileage
Each rental includes a daily kilometre allowance, as listed on the vehicle's page and stated in your booking confirmation. Kilometres beyond the included allowance are charged at the per-kilometre rate for that vehicle, also shown on the vehicle's page and in your booking confirmation.
9. Delivery & Collection
We deliver and collect vehicles across Portugal — to airports, hotels, villas, resorts, marinas, and private addresses. Delivery and collection within the Algarve region is free of charge. Delivery to other locations (for example Lisbon or Porto) may carry a delivery fee, which is always quoted in advance as part of your booking confirmation.
Delivery and collection times and locations are agreed during your consultation and stated in your booking confirmation. If you need to adjust them after confirmation, contact us as early as possible and we will accommodate changes where we can.
10. Using the Vehicle
The vehicle may not be used:
- (a) By anyone not named as a driver in the rental agreement;
- (b) Outside mainland Portugal without our prior written authorisation. If you wish to travel outside Portugal, contact us in advance — authorisation, where granted, may require additional insurance arrangements;
- (c) In violation of traffic laws or regulations;
- (d) For racing, competitions, track days, or driving instruction;
- (e) To carry passengers or goods for hire or reward, or for any other commercial purpose, without our authorisation;
- (f) While under the influence of alcohol or controlled substances.
Serious breach of these restrictions entitles us to terminate the rental immediately, voids insurance coverage, and makes the renter liable for resulting damage and costs.
11. GPS & Vehicle Telematics
Vehicles in our fleet are equipped with a GPS tracking and telemetry system (Cartrack), which automatically records GPS location, speed, ignition events, mileage, harsh braking and acceleration events, geofence violations, and engine (OBD) diagnostics. This data is used for vehicle security, theft prevention and recovery, emergency and roadside assistance, fleet management and maintenance, monitoring compliance with territorial restrictions, and investigating accidents or incidents where necessary.
DeluxeDrive LDA is the data controller and Cartrack acts as a processor; internal access is limited to authorised personnel. Telemetry data is actively analysed during the rental and for up to 12 months after it ends; thereafter it may be retained only as needed for legal claim periods (up to 5 years under the Portuguese Civil Code). Data is processed in accordance with the EU General Data Protection Regulation (GDPR) and Portuguese data protection law, and may be shared with law enforcement where required by law. You may exercise your GDPR rights or request information about data collected during your rental — see our Privacy Policy.
By signing the rental agreement you consent to this tracking for the duration of the rental. Tracking systems operate continuously during the rental and may not be disabled or tampered with.
12. Accidents, Damage, Fines & Tolls
Any accident, theft, or damage must be reported to us immediately. For accidents involving third parties or significant damage, a police report must also be obtained. Following these procedures is a condition of insurance coverage.
During the rental period, the renter is responsible for:
- (a) Damage to the vehicle for which the renter is responsible under the rental agreement, with the security deposit applied first (see Sections 5 and 6);
- (b) Traffic fines, tolls, and associated administrative costs;
- (c) Damage beyond normal wear and tear, including interior damage and smoking odours;
- (d) Lost or damaged keys, documents, and accessories.
There is no car-wash requirement or cleaning penalty for normal use — return the car as it is.
Specific charges
So there are no surprises, these are the specific charges provided for in the rental agreement:
- (a) Smoking in the vehicle — fixed fee of €500 for odour treatment and deep cleaning;
- (b) Pets — allowed only with our prior written authorisation. Unauthorised transport, or return with animal hair, odour, or damage: actual detailing cost per invoice plus a €100 administrative fee;
- (c) Excessive soiling (spills, stains, or any condition requiring cleaning beyond the normal turnaround): actual detailing cost per invoice plus a €100 administrative fee;
- (d) Lost or damaged keys or access devices — actual replacement cost per manufacturer invoice plus a €100 administrative fee, and any associated recovery or towing costs;
- (e) Traffic fines — a €30 administrative fee per process for identifying the driver to the authorities;
- (f) Damage processing — a €50 administrative fee per damage case, in addition to repair costs for which the renter is responsible;
- (g) Misfuelling and renter-caused immobilisations (keys locked in, flat battery from equipment left on, running out of fuel) — actual assistance, towing, and repair costs.
13. Returns, Extensions & Late Returns
The vehicle must be returned (or made available for collection) at the time and place agreed in your booking confirmation. If you would like to keep the car longer, contact us as early as possible — where the vehicle is available, we will be happy to extend your rental at the applicable daily rate.
If the vehicle is returned late without an agreed extension, each day (or part-day) of delay is charged at the highest rate applicable to the vehicle's category, in addition to any further losses caused by the delay. Retaining the vehicle beyond the rental period without contact or agreement may be treated as unauthorised use and reported to the authorities.
14. Changes & Cancellations
Enquiries and quotes are free and carry no obligation — you may simply decide not to proceed, with nothing owed.
Once a booking has been confirmed, the change and cancellation terms that apply to it are stated in your booking confirmation and rental agreement. If your plans change, contact us as soon as possible — we handle every case personally and will always look for the most reasonable solution.
Returning the vehicle before the agreed end of the rental does not reduce the price: the full agreed rental price remains payable, as set out in the rental agreement.
15. Our Responsibility to You
Because we operate our own fleet, we take direct responsibility for it. Every vehicle we deliver is owned or operated by us, professionally maintained, inspected before each rental, and insured (see Section 6).
If a reserved vehicle becomes unavailable before delivery (for example due to accident or mechanical issue), we will offer you a comparable or superior replacement, or a full refund of any amounts paid.
Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under Portuguese law, including liability for death or personal injury caused by our negligence, or your statutory rights as a consumer. To the extent permitted by law, we are not liable for indirect or consequential losses (such as loss of profit or business), and we recommend not leaving valuables in the vehicle, as we are not responsible for personal belongings left in it.
16. Data Protection
We process personal data in accordance with the GDPR and Portuguese data protection law. Details of what we collect, why, and your rights are set out in our Privacy Policy.
17. Complaints & Dispute Resolution
If anything falls short of your expectations, please tell us first — contact info@deluxedriverentals.pt or WhatsApp +351 963 584 279 and we will do our best to resolve it directly.
As a company operating in Portugal, we provide access to the official complaints book (Livro de Reclamações), including its electronic version at www.livroreclamacoes.pt.
In the event of a consumer dispute, you may also resort to an alternative dispute resolution (ADR) entity under Portuguese Law no. 144/2015, such as CNIACC — Centro Nacional de Informação e Arbitragem de Conflitos de Consumo (www.cniacc.pt) — or the regional consumer arbitration centre for your area.
18. Governing Law & Jurisdiction
These Terms and every rental agreement are governed by Portuguese law. Disputes are subject to the jurisdiction of the Portuguese courts, in particular the Tribunal Judicial da Comarca de Faro, without prejudice to any mandatory consumer protection rules that entitle you to bring proceedings elsewhere.
